All
This post regarding my daughter who recently come with my wife on spouse dependent settlement visa.
My daughter just comes from Pakistan on march 2018.

I have question can I apply my daughter indefinite leave to remain now.
Because when she born in karachi im on appeal. Than after I got indefinite.
Now I'm British passport holder.

I have read this home office web site.

Who is eligibility of child under 18.

Given below exact.


You can apply as a child under 18

You may be eligible for settlement ('indefinite
leave to remain ') if you're under 18 and you live in
the UK with I ofthe following:

. both your parents who are British citizens or
settled in the UK
. one of your parents who is settled or settling in
the UK and the other parent is dead
. one of your parents who is settled or settling in
the UK and has sole responsibility for looking
after you
' one parent or relative who is settled or settling
in the UK and there are compelling reasons why
you should be allowed to stay

'Parent ' means:

. a natural (biological) parent
. an adoptive parent
' a step-parent where the biological parent has
died

If you read third option.

Like one parent is settle in uk.
On compelling ground?????
So I cannot understand how can I apple indefinite of my daughter.

She will only qualify for ILR when your spouse does.
