Naturalisation & British Citizenship for child

Post by jananj » Tue Jul 17, 2018 6:17 pm

My kid was born in India. At the time of my son's birth, my husband was on Tier 1 visa. He is now a British citizen though.
My kid is now on PBS dependent visa. I am going to apply for ILR. If my application is approved then i will be on ILR and since my husband a British now, can my son apply for Naturalization and then British passport without having to wait for 5 years (as listed below)
1. 5 years >> ILR !!! >>>>> Naturalization >>>>> British Passport ???
or
2. Naturalization >>>>> British Passport ???

Children born abroad are expected to hold ILR and will follow the same route as you. He has no entitlement to register as British.

You should include him in your ILR application so he gets ILR too.

The child should be included in your ILR application form, and once granted ILR, can immediately apply for registration under Section 3(1). provided the child has ILR, s/he does not need to wait for five years before applying for registration.

If you have resided in the UK for three years and were physically resident in the UK three years prior to the date of application, you can also apply for naturalisation immediately after getting ILR, as your spouse is now a British citizen.
