ILR Long Residence query

Hi all,

I am in need of help in filling up my application by the middle of Oct 2018.

I came to Uk as Student on 7th Oct 2008.
(completed my masters)
Now I am on Tier 2 General which valid till may 2020.
My Questions:-
1. Can I apply for ILR 28 days before the matured date?
2. Can my Dependant remain on Tier 2 Dependant on the current visa when I changed my status to ILR from Tier 2 G? If my wife is supposed to change, which application for her to be my Dependant again? (she is in the UK for only 3 years so far)
3. Do I need to fill up the FLR(LR) application?
4. what are the documents do I need to provide? and requirements?

Could you please clarify my questions as above?

1. By "mature date" presumably you mean the 10 year residence date when you Qualify?? If you meet the requirements for long residence ILR, you can apply within 28 days before the 10th anniversary of your date of entry to the UK.

2. No. Dependent will have to switch to FLR M and meet the English and financial requirements. The clock for ILR will be reset to zero and a new 5 year residence period, 2 x 2.5 years visas, before eligible for ILR.

3. No, for ILR based on long residence for you it is form SET LR.

4. Read the form and guidance notes, it tells you.

2. I did not quite get it on this one. Can't I add up as dependant along with my application? Can we apply for 5 years visa rather than 2 times extending? I am just wondering about the financial requirements? for instance how much funds and how long it for b4 make the application?
3. Do we need to pay for IHS fees? I assume not for me, but for my spouse?

Please advise on that so I can plan!

If you apply for ILR based on Long Residence, which is what you have asked about, then NO, you cannot add your dependent as Set(LR) does not permit dependents to apply with you. She will have no other option but to change visa category and start a new 5 year residence period. If you apply for ILR based on long residence, then she applies on FLR(M), you need to prove that you earn a minimum of £18,600pa with documentary evidence for 6 months. She also needs English A1 test.

If you apply for ILR based on Tier 2 General and 5 years residence, then she can continue to extend her PBS Dependent visa till she qualifies for ILR. If you choose this ILR route, you only need to prove 90 days maintenance funds for your dependents extension application as PBS Dependent.

For ILR no. For spouse yes, £600 for PBS Dependent visa extension plus visa fee.

Yes, Naric Assessment?
There are two NARIC assessments that she needs to be able to use it. English Language Assessment and Comparability Assessment. It costs roughly £150, same as the English test.
