ILR SET(LR) Forms Documents

Hi all,

wondering if i could get a clarification on someone familiar with the time period to apply for ILR based on 10 year Long Residence Stay.

I've somehow always thought the ILR (10 year long residence route) required a leave of less than 180 days within 10 years. Must have interpreted this wrongly during my uni years.

So i would like to find out if i stand to apply for ILR in a few months time based on my circumstances

Entered uk as student tier 4 visa ( 19/09/2008 - 31-10/2012)
Extended as student for a further year from 12 to 13.
PSW was removed in 2013 thus i stayed on in UK as a special tier 5 visa negotiated from student in my course to do a registration.
Tier 5 finished in October 2014 and left the country. (visa ended) My company rehired me back in February 15 as they were awaiting a completion on a merger deal which i reentered then.

My main question is during the time of visa absence which is from early Oct 14 to early Feb 15, i was back in my country. Would that count as a break of the 10 year continuous residence even though it was less than 180 days? Or do i still stand to apply for the ILR in Oct 18 (in a few months time) as i've entered as a student in Sept 08. During the period of Sept 08 to Oct 14, i have left the country for holidays abroad but the longest of such was maximum 2 months at a time within a year (due to summer breaks etc during Uni).

Any help from anyone to clarify these would be greatly appreciated. As i would not want to waste the application fee of 3k just to know i would not have stand a chance in the first place as i've got a Tier 2 Visa running for 5 years as it stands.

Depends on if you had valid visa when you left the UK . If you still had valid visa on the day you left, then your are fine. Otherwise your continuous period of stay was broken

So i left on the 9th Oct 14, (visa expiry was 10th Oct 14 - visa tier 5), re-entered in Feb 15 under new visa (tier 2 - general). So based on that the long stay chain is not broken am i right? as i think i saw a previous comment of yours that leave with valid visa and reentering with a new visa is a continued stay.

Just wondered on another quick thing in regards to the above scenario which i saw in the application, leaving with the intend of not returning to the uk. (would i have to justify the extended period of absence during the oct 14 to feb 15)? like such as why did i not apply for a tier 2 quicker and come back to work? or does it not matter? As i left on the last day of my visa, (if i was a case worker - it seemed to me that would mean u left with no intend to return?) just a thought or probably im overthinking.

Yes. If you leave with a valid visa and then return within 6 months with a new entry clearance your lawful residence period will be intact

You do not need to provide any reason. The rules allow such abcenes as long as it was less than 6 months.

I can now persuade myself to part with the application fees this coming October when i'm eligible to apply for it then. Now just to start preparing all the documents needed.

Sorry to trouble everyone here again, but i'm trying to seek some clarification for the documents needed to submit for my SET(LR) forms.

On the Documents sections, documents of different types to show continuously resident in the uk during any periods of which unable to show a passport?

Does that mean if i have all the previous expired passports which i'm submitting, I would NOT need to submit any of the listed documents? So technically for my application, it would be a straight forward application - considering i am submitting all my 3 passports which i've held since 2006 till 2018, 2 expired BRP.

2. In regards to PSC appt, do we try and book in advance(pay the premium add on fees) and then submit the online forms after?
or should we still opt for paper form for PSC appt route. as in book first then bring the paper submission to the appt itself.

Correct. If you have all your passports, including the one used to initially enter the UK, then you DO NOT need the other documents. The form does say extra documents only required if you don't have the passports.

If you apply online using Set(LR), booking an appointment is part of the process and all fees are paid online.

If you choose to use the paper form, you can still book the appointment on its own and pay all the fees online.

So if i'm applying online with the SET(LR) form, does that mean i can (Bypass) trying to book the PSC appt on the other webpage? So i should go to apply online, and it should (fingers cross) have an available appt for me to book with all the relevant fees added?

Seems like the PSC appt booking is so tedious, so i have been attempting to book and secure the appt and sort the forms after and still having no luck whatsoever.

Correct. You should note that there are currently issues with the appointment system and you might have a few issues. Many posts currently on the forum about this.

If you book the appointment without the online form, you cannot then use the online form and will have to use the paper form.

Sorry to bump an old topic,

but been trying to get a Life in the UK test booked but to no avail to find one that fits my work schedule at the moment. There is one that i can fit in which is the sat before the bank holiday.

Just a quick question, I will be applying for ILR through SET(LR) online , and opting for the premium booking service, will be trying to get one booked in.

On the online forms, can i skip through the life in the uk test first and submit it along side my application when i book the premium service centre? Or must i submit all of it together with confirmation of Life in the uk certificate?

Just in the midst of filling in the form on the Online version of SET(LR) form, I've now come across some weird questions?
Do you have any family in your country of birth, nationality or any other country where you have lived for more than 5 years? Yes Provide details
Do you have any friends in your country of birth, nationality or any other country where you have lived for more than 5 years? Yes Provide details
Are you part of any social groups or do you have other cultural ties in your country of birth, nationality or any other country where you have lived for more than 5 years? Yes Provide details

I dont see any of these questions in the normal paper forms?

Do we have to declare everything? or just listing 1 example?

Do u have any friends? That seems erm abit too vague? Am i meant to list all known affiliates and friends? And what do they mean by cultural ties/social groups?

Hi All,

Just got a quick query to make as i have just found out that my sponsor license for Tier 2 is expiring on the 17th of Sept 2018.

I am scheduled for my premium ILR appointment on the 20th of September 2018. for SET(LR).

Would there be any issue to this for my application via SET(LR)?

Or should i get my employer to extend their sponsorship license to prevent any issue?? They arent that keen to extend considering they have stopped taking in tier 2 for the last year but i would imagine all the current tier 2 employee that we have will all have our visa revoked if their sponsorship license is expired?
