FLR(M) guidance notes query

Hello,

Could someone please help. I have had ILR for 5 years I gained this after being sponsored and being granted a 5 year work permit. I got married to my wife when she was on a student visa in the UK. We applied for a spouse visa 2.5 years ago through FLRM and she was granted the visa. We are now about to apply for a 30 month extension through FLRM and I have been reading the guidance notes and I have seen the following point three quarters down on page 2 of the FLR (M) guidance notes “ you must not use this form to make an application for an extension in the following categories: as the partner or dependent child of a person granted indefinite leave to remain in a work or study route, if you are currently in the UK as their dependent”

This is a bit confusing... I was under the impression that FLR(M) is the form we should use for the extension as this was the form that we used for the original spouse visa. Just to confirm again, I did get ILR through a work permit route.

Below the point it says “ for further information please go to a gov.uk link that has absolutely no useful additional info.

If someone could please shed some light on this I would appreciate it.

FLR(M) is the correct form as a 2.5 year extension of the route to settlement (ILR) she is already following.

Thanks for your response. Are you able though to explain that point which is in the guidance notes. Essentially it’s says because i got my ILR through a work based route that a different form should be used... i do not understand why this point Is in the guidance notes for FLRM

It is not relevant to you as your wife applied for her visa AFTER you already had ILR.

She did not apply as a dependent while you had a PBS work visa.
