UK PR 5 yrs is calculation and after...

Hello All :roll:
Can someone please advice :? me I am a nurse working for NHS for last 2 years ; however I was out of the country for maternity leave almost 1 year .

1. Will this delay my UK PR since I was outside for 1 year ? if yes by how much ??

2. Also once I get PR - how long can i stay out of the country UK. what is minimum requirement to keep PR valid ?

3. Can I remain on PR only and not go for UK citizenship or passport ? Does the PR expire after 5 years and have to reapply ? or can I keep PR active by traveling once a year

any advice will be helpfull thank you :cry:

Your clock was reset to zero and the time you resides in the UK counted only after you are back from your maternity leave and back to the UK.

2. Also once I get PR - how long can i stay out of the country UK. maximum 2 years what is minimum requirement to keep PR valid ?

Does the PR expire after 5 years and have to reapply ? expire after 2 years if you are not in the country. or can I keep PR active by traveling once a year. You may be still granted the entry once or twice, but when the custom officer finds that you only short stay once every year, you may be denied for the entry even you have ILR VISA - this is because the purpose of your entry is NOT long term residency, the original purpose of this type of VISA

The only way you can travel in and out the UK without any immigration control is to have right of abode (the UK citizenship).

I didnt quite understand

I was working in UK for June 2015 to June 2017 ; 2 yrs . I went out of country from july 2017 and reported back to work on 2018 June.. so you are saying my 2 yrs wont be considered for 5 yr PR ? I have to start again ???

You were absent for more than 180 days and this makes you ineligible for ILR as any absence of 180 days or more breaks continuity of residence.

and the worst is: Tier2 can only be granted 6 years continuously maximum. So now you can only stay in the uk under Tier 2 visa 3 years further. And have to leave the country for 1 year to cool off and eligible to the Tier 2 again. Or you can switch to the other visa if don't want to leave the UK. but either way you won't be eligible to apply PR under 5 years PBS route.

is there any possibility UK immiragtion will make an exception ..for 180 days rule for pregnancy ? :(
Can the hospital / NHS help in any way in my case ...

Some of my co-workers are saying it may be possible..if you let them know the circumstances .. have you guys ever come across any case ????
