When I become British, under what category can my family apply for, from PBS dependents

Post by kalven » Wed Aug 01, 2018 12:10 pm

I can apply for one day application for ILR on Jan 30th 2019. My Daughter (Born in UK) and Wife's PBS dependent would end on 20th Feb 2020. Now I would be eligible for naturalization on 30th Jan 2020, if I am not wrong? and I can make this application on the day I am eligible for BC.

Does my daughter not need to go through MN1 if I become BC before her PBS dependent expired? if not

In this stage what is the best advise to me?

1. Wait for BC and then register my daughter as BC (via MN1) and my Mrs as BC/ILR based on 3 years route (she is UK for more than 5 years:Tier 5 2 years + Tier 2 3 years)

2. Or should I extend their visas before I apply for my BC on 30th Jan 2020 because their's will be due to expire in a month (20th Feb 2020).

As there are many situations here, I would appreciate the any advise.

UK born child is entitled to register immediately after a parent is granted ILR.

Hi

Thanks for the response.

Does waiting till I become a BC doesn't not make any difference?. I thought I can skip the MN1 process if I become BC and both me and my child can naturalize together? or apply British passport for child directly?

Also in case of my Mrs.

If I apply for BC on 30th of Jan 2020, and my Wife's visa PBS expiring on Feb 20 th 2020 - can she still wait for my BC to arrive so that she can Apply for BC on 3 years route ones I receive it? This could save a lot of fee - Please advise

You can apply for UK born children on form MN1 as soon as you have ILR. They have an entitlement to register as the link vinny provided states. They cannot apply directly for a passport as they are not yet British.
Also in case of my Mrs.

She cannot apply for citizenship if she DOES NOT hold ILR.

Thanks for the response again. This is very clear now. However, I would like to know if the following route exist?

When my daughter gets BC, and I am in ILR, would my wife be eligible to apply ILR as Parent of a British child? I am not sure if any such route exists

No she would not. Parent of British Child is a new 5 or 10 year visa route application on FLR(FP) and only for a single parent who is no longer in a relationship with the other parent.

Your wife must simply continue on her existing visa till she qualifies for ILR. There is no 'short cut route'.

That was much clear and straight. So the only option is to continue as PBS for next 3 years and apply for ILR from there.. Hope there is no change in rules in that 3 years

Many Thanks for the support

She can apply for ILR when she reaches the 5 year mark as PBS Dependent but an extension will be for 3 years yes.
