Refusal of returning resident visa

Hi all. I was settled in Uk in 2003 and got ILR in 2005 and suddenly in 2010 I came to India to take care of my grandmother as she is alone.She got heart attack and my family told me to live with her as no body is dere to take care of her.i also got married in 2015 and my husband is mostly on on-site job and now my cousins has grownup and they look out my grandmother. My parents and brother are British citizens and now they want me to come back to Uk so I applied returning resident visa but home office refuse it and they said that I had not lived my most life in Uk as today I m 28 yr old. But I have a strong family ties so I think I am eligible to get returning resident visa. .so please guide me what can I do to and which visa I have to apply

So, just to clarify, you have been absent from the UK for 8 years (ILR automatically expires after 2 years, unless you have strong connections to the UK) and while abroad, you married and effectively started new family life abroad. Can you see why the Home Office may conclude that your connections to the UK are not that particularly strong and therefore that you do not qualify for a Returning Resident visa?

How many years did you live in the UK?

Thnx for ur reply.I have spent 7 years continuously in Uk from 2003-2010 and got ilr in 2005 my parents are living in Uk and they are British citizens and we have our own home in Uk. Home reject on basis they said I don’t spent most of life in Uk under paragraph 19 but they don’t consider that I have a strong family ties in Uk and want to resume my full life in Uk

It is very difficult to argue that. You also lost your settled status long time ago. From HO's perspective, you are an adult living an independent life in India and have been away from the UK for over 8 years. Simply having part of your family in the UK is not a strong grounds to return after 8 years. It's not like your children or your partner are British citizens. Did you regularly travel to the UK ?

I just received my returning resident refusal today, my situation was somewhat the same but with differences. I had had ILR from 2002, happily married and 2 British born children. I returned to Australia in 2013 as my mother was mentally ill after her husband was convicted of child sex offences including that of my niece. My mother tried taking her life multiple times. My wife and children remained in Uk, working and School alike. They visted 5 times in 4 years for extended period whilst maintaining Uk Work and School ties. Thankfully my mother now has complete health and full time care. They refused my application on the 2 year rule and the fact that I’m working on Australia. The same work that has funded my family in the Uk so they have not resorted to public funds. I have already sent appeal tonight and have email returned saying it’s a 28day process. Good luck with what ever you do, thought I’d share that your not alone with a refusal.

Administrative review processing time

Hi, I have applied an administrative review on 7 may but not received any feedback from their side except welcome feedback when I am applying administrative review so anyone tell me the processing time of administrative review and where I can contact to get know the status

You cannot check the status of an application. Standard time frame is around a month

I am the daughter of British citizens and live in India now my parents wants to call me back to U.K. And join them so I want to confirm can I apply a family of settled person visa. Currently I am 29 yr old and married in India and want to join my family permanently

No you do not qualify for an adult dependent relative visa or any visas as a dependent of your parents.

You would have to find your own visa that you qualify for, ie. Student visa or tier 2 general work visa etc.

is there any visa which I can apply on the basis of my family. Family of a settled visa might be provided for a family members to live for more than 6 months in U.K.

No there is not. That is the adult dependent relative which you don't appear olto qualify for.

A 2 year visitor visa doesn't give you the right to reside in the UK for 2 years. You would be unable to spend more time in the UK in a 12 month rolling period than you are spending in your home country.

Doubtful in the circumstances that you would be issued with even a 6 month visitor visa, due to your prior intention to settle and the risk of overstaying.

There is no visa category for the ownership of property.
