My Eligibility to apply for naturalization

Post by meryam1979 » Sat Aug 04, 2018 11:07 am

I will appreciate if somebody can let me know when I can apply for my naturalization as per the information given below:

The reason I want somebody to look into it is because it is a little off the normal circumstances.

My objective:
To apply for naturalization as soon as possible.

My circumstances past and present:

- I was granted ILR in Sept.2011 ( as im married to a British Citizen)

- Same month Sept 2011 I had to accompany my husband abroad as he got a job there and then we came back to UK in June 2016. but i travelled in between that time to UK so that my ILR could be retained.

- Now my Question is :

We have come back on 1st June 2016 and not travelled out of UK since then. If i work out the 3 year period from 1st of June 2016 ( the day i came to UK) it will be 1st June 2019.
If I take out the 270 days (provision for being outside UK in the 3 years) from this period it comes to 4th Sept. 2018.
So my question is can I apply for the naturalization on 4th of Sept. 2018? After taking the 270 days off, rather than waiting till the 1st of June 2019.

Thanking in advance.

You will have to wait until the third anniversary of your return to the UK.

There is a requirement that you were physically present in the UK at the start of the three year period immediately preceding the date of application for naturalisation. And the Home Office has no discretion to ignore that requirement. Failure to meet that requirement means certain refusal and loss of fees.

Was your husband posted abroad by the government or a government agency (British Council, etc) for whom he worked?

1. We're you physically present in the UK on 4th September 2015??

2. Absence is not counted forward for possible absence in the future to be used. The 270 days is absence in the past immediately before the date of application. You can't say "I qualify on 1st June 2019 but want the absence taken off in advance to apply earlier". It doesn't work like that.

Thank you for your reply.

No its not a government job. He has a private job. and he travels back to UK every 60 - 70 days to and he t see the kids. This is becoming very stressful emotionally and financially.
Is there no way we can speed up the naturalization process so that the kids and i can also be with him abroad as the kids are very young only 4 and 5years old.

No. The three year physical presence requirement is a mandatory/non-discretionary requirement for naturalisation.
