Just a quick question

Hi all,

I applied for tier 2 and they asked me certain documentation which I was unable to provide and I varied my application to FLR FP. Now they asking me again for certain documentation, which I don't think I will be able to provide. So, if they refuse my FLR Fp will I become an overstayer? My solicitor told me that I can make another application and if thats refused then I will become overstayer. Any advise on the above would be greatly appreciated!

Yes. You will become an overstayer after refusal and when the section 3C ends

Thanks for your reply zimba. So you mean to say after refusal of any kind of visa we become an overstayer? without us having to make a fresh application, which would continue the stay?

Yes. Your status will be an overstayer but UKVI will not seek to deport/remove you if you have a pending application

I have still 11 months to go before I qualify for ILR 10 years route. Anyone of you could please advise me how to get there without having to break my continuous stay will be very kind of you.

You can only get ILR under long residence if eligible and have 10 years of lawful residence. It seems you are trying buy time as you cannot justify your residence in the UK. Why can't you provide the required documents ?

I have provided them the documents but not exactly how they want it. So, I am assuming they will refuse it. My solicitor said he is 100% sure that I can make a fresh application without breaking section 3C after the refusal. I am confused and couldn't understand how. Just wondering how to go from here.. Can I make a fresh tier 2 application? Advise on this would be greatly appreciated.

What documents for tier 2 applicantion did HO ask for that you could not provide??

Hi,
They have asked me for my bank statements when I applied for tier 2 and I was about to provide, but then my sponsor withdrew his sponsorship as they were looking for candidate to join urgently that left me nowhere and I had no other choice other than to vary my application to FLR FP. And for Flr Fp they asked me to provide documents that we are in relationship since March 2016 to March 2018, but I have provided them from 1st September 2016 to till date, which will be 2 years by the end of this month. Another document they asked is my medical report related to my psychological stress, if I am on any medication, why am I not fit to travel and if any special arrangements can be made for me to travel. I really am going to lot of distress which I would not like to mention here. But they just want evidence. Don't know how to provide such documents. Please advise.

Hi All,

I Originally came to this country in August 2009, was student for 3 years, post-study work permit for 2 years, tier-2 general 3 years, and second extension Tier-2 general for 3 years. My second extension tier-2 was cancelled in July 2017. I received letter from Home office in February of 2018 giving me 60 days time. On 10th April 2018 I applied for tier-2 again, but had to vary it to FLR FP for some reason, which got refused with no in-country right of appeal on 13th December 2018. I am 7 months short of completing my 10-year ILR. I have been advised by my solicitor that I have one last chance to make a fresh application.
1) Which is the best application to make and how long will I have to make new application after the date of refusal?
2) If I make a new application, will the HO go through my previous history and reject the new application?
Quick response would be highly appreciated!
