ILR rejected due to 'breaks'

Post by Alsilis » Wed Aug 01, 2018 12:04 pm

My daughter's application for ILR was rejected due to some breaks in her residency during 2009/2010, these breaks were because of payment processing errors and sending the wrong form but they've said that that time is invalid and as she came here in 2007 from Pakistan her years between 2007-2010 are invalid and she will have to wait until 2020 until it has been 10 years. They said we can't appeal this decision but my daughter needs to apply to university this year and without ILR she won't be able to get the funds and we can't afford 20k in fees to her uni. Is there anything we can do to show them we had lawful residency during them 'breaks' and her dad has British citizenship and mother has ILR and will be applying for British in October.

Useful to state her full UK immigration history, including visas held and all dates (visa start/expiry, application dates etc).

How old is she??

On what basis did she apply for ILR, 10 years long residence or ......??

Long Residence ILR Refused

Post by Alsilis » Wed Aug 08, 2018 1:24 pm

I applied for ILR through the 10 year route for my daughter but it got rejected due to a gap in her residency during 2010 which was because we accidentally messed up the credit card details so that created a 4 month gap. Problem is she is applying to uni this year and without ILR she is a international student and we can't afford to pay 30k in fees. They said we can't appeal this decision and i've talked to a couple of solicitors but they're all telling me different things (ones saying complete SET (F), other's saying to leave it, other's saying to get letters from her school, doctor and MP to show she needs ILR for uni ) Is there anything we can do as we really don't want her to take 2/3 years gap from uni. I (mother) have ILR and will be applying for naturalisation in October. Please let me know if there's anything we can do

I split your post from the very lengthy ILR LR topic as not many members will respond to you there and your questions will be lost.

Please keep all your questions in this topic now.

What is the visa/immigration status of her other parent?

What is your daughters full UK Immigration history, including all dates please?

Unfortunately 'home university fees' are not compelling circumstances. She failed to meet the requirements for long residence through your own error based on what you state.
