ILR on Tier 1 Ent Route (50k)

Post by Amz » Wed Aug 08, 2018 2:37 pm

I have discussed below on other people's posts but i am not 100% in line with what People have said so i am sharing my details below if any respected member could answer both of my questions ?

Question 1:

Initial Grant: 3rd April 2014
Extension Applied: 25th March 2017
Extension Granted : 22nd June 2018
Extension End Date: 20th June 2020
ILR Due ( 5 year completion ) : 3rd April 2019

I am Due for ILR extension, I wanted to Make sure if I can count the Period Between 1st March 2018 - 30th March 2019 (12 months) as part of my employment or not as my ILR due date is less that 12 months of my Visa Grant which was June 2018 ? is this correct or not ? (the thing i am worried about is that period between March 2018 - June 2018 was when i was waiting for my extension, would that count if I am due for my ILR in March 2019 ? )

Guidelines Say: '' The jobs must have existed for at least 12 months during your most recent grant of leave or, where that leave was granted less than 12 months ago, for at least the 12 months immediately before the date of your current application. ''

As per my understanding of the Guideline rule, I can count the period between MArch 2018 - June 2018 (I was waiting for my extension at this point in time) and I can apply in March 2019 which will count as 1 year of employment (March 2018 - March 2019)

Question 2:

I would also like to know about my Dependant (Wife)

She joined me in UK in March 2015 and her 5 year Route will be completed in March 2020 whereas her visa grant is until June 2020. Once I get my ILR in 2019 as mentioned above, would it be ok for my wife to remain on dependant visa until March 2020 and apply her ILR or does her ILR clock resets ?

Sorry to be a pain, I would appreciate if the above is answered

Regards

I will answer your question 2. Others will have to answer your question 1.

She can remain on her current visa until she qualifies for ILR. If you ILR fails though, so will hers as she cannot apply for ILR independently from you if you don't get ILR.

Correct. Assuming you are apply early 7th March, you can take in the employment from 8th Mar 2018 to 7th Mar 2019

After NEW RULES March 2018 to June 2018 if you have two employee full time then countable and you can apply March 2019 ILR

1st March 2018 to 31st March 2019 With RTL FPS PAYSLIP ALL 12 months period, you should be ok for ILR.

Thanks
