Tier 2 ICT Rules

Post by bertie » Wed Aug 08, 2018 11:42 pm

Hi Guys,
I came to UK on Tier 2 ICT - long term staff in 2014. It was initially given for a period of 2 years up to 2016 and was subsequently extended for a 3 years up to 2019. Now, as per the rules, can it be further extended and for how long? An immigration lawyer recently told me that it can be extended but the rules stated on gov.uk say otherwise. Please can someone help clear the confusion?

Thanks

Did you ask the immigration lawyer on what basis ?
As there is no extention beyond 5 years without the cool off of 1 year ..

You can only stay longer than 5 years (9 years max) if you are a Long Term ICT visa holder and earning in excess of £120k per annum, as clearly stated on the HO website.

https://www.gov.uk/tier-2-intracompany- ... orker-visa
How long you can stay
You can come to the UK with a Tier 2 (Intra-company Transfer) visa for up to the maximum stay allowed for your visa type, or the time given on your certificate of sponsorship, whichever is shorter.

The maximum stay for each type of Tier 2 (Intra-company Transfer) visa is:

Long-term Staff (if you earn more than £120,000 a year): 9 years
Long-term Staff (if you earn less than £120,000 a year): 5 years, 1 month
Graduate Trainee: 12 months
Char (CR001 not Casa)
