Really confused

Post by ARider » Sat Aug 11, 2018 12:10 am

Hiya, my case is a but complicated, hence worrying my pants off. So please help as much as can with your knowledge! Here you go:
I am a Bangladeshi citizen, been in UK since 2009(9 years 3 months so far) but since 2013 I have been in a civil partnership and my partner is British, git my second spell of the visa for 30 months, which will finish next year September, but as I would complete my 10 years in coming may, I was planning to apply for ILR, but things has changed dramatically between me and my partner for more than a year now, he likes to drink, and when he does he gets abusive, threatening by saying (I will divorce you and deport your a$$ back to Bangladesh etc) good time to mention that, we share our flat with our best friend (a girl) she knew what I was going through mentally, and we fall in love with each other for couple of years now! If you didnt realise yet, i am bisexual. Now, I want to dissolve my civil partnership and marry this girl (forgot to mention, she is Polish) finally enjoy life a bit without being worrying every single minute about threads and being abused at. I am really confused, so please provide me with your suggestions. Thanks

The challenge will be to convince the HO that your relationship with an EEA national female is genuine, after being granted a spouse visa as a civil partner. Even more so if she is a flatmate and 'best friend' of you and your partner.

In order to marry in the UK you would have to register with a HO designated Registry Office. The Registrar is then legally bound to notify the HO who can then extend the notification period from 28 to 70 days in order to interview you both separately before the marriage can go ahead.

Once your Civil Partnership is dissolved your right to remain in the UK as a spouse will cease.

I've made comment on how long you've been bi-sexual. I've simply explained how the HO might consider the validity of your marriage.

You will also have to consider the fact that once your current relationship is no longer subsisting and your civil partnership is dissolved, you will be without valid leave until you are able to marry your Polish girlfriend. You won't be able to register your intent to marry until your civil partnership has been dissolved and you may then have to wait a further 70 days for the HO to investigate your relationship.

Any gap without leave will break your 10 years of legal residence.
