Hi all ,

Good Morning!

I have couple of questions regarding Tier 2 General Visa. Please help me clarify the same.

My Wife is currently in UK on “ Tier 2 (General) Leave to enter “ Visa (valid from 2018 to 2023 which is 5 yrs) and myself( husband ) on Tier 2 ICT extended recently in July 2018 and have valid visa till sep 2019( I am also in uk)

Clarification 1:- Is my wife eligible for UK settlement as she is on Tier 2 General - Leave to enter visa after 2023 where she completes 5 yrs???

Clarification 2:- myself currently in Uk on Ict Tier 2 - can I apply for Tier 2 General visa dependent within Uk?

Yes, if she meets all the requirements, including salary for ILR and the absence limits etc.

Thanks a lot CR001. Sorry to but I know the 180 days max leaves in 5 years but not sure on the salary eligibility she needs to meet. She is currently on 40,000£. Does she qualify for ilr? If there is any reference document for eligibility please share the same.

Salary should be fine yes, provided she meets what the salary stated in the SOC is at the time of applying for ILR. What that will be in 2023, no one can say now as SOC salaries are reviewed from time to time and updated.

The immigration rules are the best to look at as they take precedence over any 'guidance' notes.

It is not 180 days total in the 5 years. Absence limit rules were changed earlier this year, link below. ANY absence of 180 days or more in ANY 12 month rolling period will result in being ineligible for ILR as the rules stand now (and they change often).
