I am a Non eu country citizen who has been living in the UK permanently 10 years. I am therefore eligible to apply for ILR (LR). I have an appointment at the Xxx Premium service on the 12/xx/18.
I have always applied for my visas on time and have never overstayed. I have held x3 Tier 4 visas. I am currently working as a junior doctor in the NHS with a pending Tier 2 visa application submitted 5 weeks ago. Current leave to remain expires on the 01/xx/18.
My email is in regards to a citation from the justice for peace court (Scotland) due to a speeding offense. Initial hearing scheduled for the 04.xx.18 where I will be expected to submit a plea. I have had extensive conversation with my road traffic lawyers who feel the case against me if fairly weak and advised me to plead not guilty and take the case to trail. I have no other convictions and no other road traffic offenses. I have been advised the most likely outcome in my case will be a not guilty verdict. if I go to court and get found guilty, I will most likely get just points endorsed on my license by the court and a fine. Disqualification or a jail sentence will be very unlikely outcomes as per x3 road traffic lawyers given the mitigating circumstances.
The issue I have is, I have heard of applicants being granted ILR (LR) with (Sp50) speeding offenses give fixed point penalties and fines by the court.
My question is, do I plead guilty and hopefully get a fixed point penalty and fine by the court and declare that to the home office, or do I plead not guilty and mention on my application I have a pending court speeding offense which I have pleaded not guilty to?
The only reason I applied for premium is because I need a reply within 1month of my appointment in other to apply for a job.
