Resettlement Visa

Post by Sapnam » Tue Aug 21, 2018 12:14 pm

Warm Greetings to all,

My query is about resettlement visa in UK. We are currently in UAE. My husband is a British citizen.
We have 2 daughters. I was on ILR till we decided to move to UAE 4 years back. My youngest daughter is also a British citizen as i had her after my husband became a British citizen. I would like to know what would be the procedure for citizenship of my elder daughter. And also if we decide to move back to UK , what all documents would i need to apply for resettlement visa for me and my elder child.

Kindly share any information you have about this.
Hoping everyone has a good day. TIA :)

As your older child was not born in the UK, there is no entitlement to British citizenship and you and the child will have to apply for spouse/child settlement visas again and start from scratch with 5 years residence (2 x 2.5 year visas) before applying for ILR again.

Why did you not register the child before leaving the UK as you had asked about this previously in 2013?

Not sure if you will qualify or get a 'returning residence' visa, which would be ILR.

ILR is lost if you are absent from the UK for 2 or more years.

Thanks for your quick response CR001

Not registering our child before we went away was a wrong decision. But now i am just looking at what options i have got. Will we get any considerations based on our previous ILR? Has anyone applied for Resettlement visa here.

Thanks.

No, you start again from scratch if you cannot qualify for a Returning Resident visa. https://www.gov.uk/returning-resident-visa

Yes many, who have had to also start again from scratch.
