Clarification on late entry (more than 90 days)

Post by timjharvey » Tue Aug 21, 2018 6:11 pm

Hi all,

Any feedback would be appreciated...

So we entered 94 days after our Ancestral visa entry became valid (visa valid from 01/09/2013, we entered 04/12/2013). We are now applying for ILR, and i'm looking for clarity over the 90 day clause... I know that the 2013 and 2014 publications of the guidance for ILR specified that you must enter within 90 days, but subsequent releases seem to have dropped the 90 requirement. They now specify that time between Issue and entry counts towards the 180 day limit. I know that the 180 day limit is variable depending on year... Is the 90 clause also variable... Does the 90 day clause apply to me? am I screwed or am I in the clear?

Thanks

Not sure if you have read through the calculating continuous residence document, first item in the Google search link below. Might answer your question

Hi CR001 , thanks, yes I have read that. So do you think that the old rule of "must enter within 90 days" no longer applies. Rather the gap in the entry period counts towards your 180 day allowance?

Thanks
