PBS Partner - Financial Requirements

Hi,

This is Srinivas. I do have couple of questions.

Before my question I will give some background.

I have entered UK in Jan 2010 on ICT Tier 2 (Inter Company Transfer) and I got ILR in May 2015 (PBS/5 years Route) and got British Citizenship in NOV 2016. I got married in May 2013 outside UK and my wife came to UK on Tier 2 ICT Long Term Staff Partner in June 2013.
Initially she was on Tier 2 ICT Long Term Staff Partner and VISA got expired in May 2016; before her VISA expiry dated I have applied for Tier 2 ICT dependent VISA and got the VISA extension for 3 years [Type of Permit: PBS DEPENDANT LEAVE TO REMAIN Expiry date: April 2019 ]. I have a child born in UK and he got British passport in Sep 2015 based on my ILR Status.

Questions.

1. By Jun 2018, my wife will be completing 5 years in UK. Is she eligitlbe to apply for ILR in June 2018.
2. Which is the earliest way of getting ILR/Citizenship for my wife? Is it through my visa status or through my kid's dependent [as he has British passport].
3. If my wife is eligible for ILR, which application form I should be using? and when is the earliest date that I can apply for ILR ?
4. My wife has completed post graduation in English medium in India. Please let me know whether this will be sufficient or need to take any English Language Test.

1. Yes if she meets the requirements (LIUK, English B1 etc).

2. She applies for ILR based on her PBS Dependent visa and 5 years residence. She needs to qualify and apply. Once she has ILR, she can apply for citizenship IF she qualifies and meets the requirements.

3. Set(O) form for ILR. No sooner than within 28 days before the 5 anniversary of her date of ENTRY to the UK.

4. No it will not be sufficient on its own. If she has a degree, she will need to do UKVI NARIC. Or do an English B1 test. Both cost the same - £150.

Dear Team,

I have a question on PBS Partner ILR (5 years route).

I am a British Citizen and my wife is on PBS dependent visa and she is eligible now for ILR after her 5 years stay in UK as a PBS Dependent. To fulfill the financial requirements of Set (o) application,
1. I have around £50,000 in my account for last 6 months and I am a salaried employee with £700 as my monthly salary. I am sponsoring my wife for her ILR and she is also employed in NHS and will get only £700 per month. Can my 50,000 savings and my salary fulfill financial requirements of ILR (SET O) application.

There is NO 'financial requirement' for a PBS Dependent applying for ILR on form Set(O)!!
