Marriage, extending stay in UK

Post by manolzelto » Thu Aug 23, 2018 10:41 am

Hi, me and my partner are planning to marry in September. I`m Czech, she is Brazilian.

Was just wondering if anyone could give me an advice regarding overstaying, her tourist visa expires beginning of September, but she is planning to stay here until mid of September so we get everything in order. We won`t get married in UK tho, we just need more time to plan it. She would overstay for about 10/11 days.

Would that be a problem down the line, seeing as she will move to Spain for a few months and then we will apply for EEA permit?

Thank you for your help!

It may be a problem if she has to make any application in the future to come to the UK on her own (i.e. not accompanied by her Czech spouse) and will definitely negatively impact any future UK citizenship application, if she is planning to settle in the UK.

It would be for the better if she leaves the UK before the end of her visit visa. Perhaps she can stay in Belgium/France for the extra couple of weeks and you could accompany here there and complete the marriage planning over there.

Hi Simon, thank you for your answer!

I was hoping "14 days grace period" can be used for such occasions. Is that not the case or do we need to notify them about overstaying?

Thanks again.

14 days grace period as far as in understand doesn't apply to visitor visas. I stand corrected though.
