UK Settlement - UK Mother + NZ Father

Hello,

I would like to know whether anyone here may be able to offer some guidance on the topic of my parents settling in the United Kingdom.

My mother is a UK citizen by birth, and my step-father is a New Zealand citizen only. They have both been resident in New Zealand, but now wish to resettle together in the United Kingdom. They have never married, though have been in a de facto relationship since the 1980s. They do not own property here, but are intending to purchase either before or after settling in the UK, depending on the requirements for settlement.

What rights, if any, does my step-father have to settlement in the UK? Would he have to go through the usual process of obtaining a spouse visa, then ILR to eventual citizenship?

Yes, the usual 2 x 2.5 year unmarried partner visa, ILR and citizenship. No quick route and if course your mother has to meet the financial requirements.

No automatic rights as being a partner of a British citizen unfortunately.

Or if your step father has a UK born grandparent, he could apply for a 5 year ancestry visa.

My step-father is retired, so it appears that the ancestry visa would not be an option for him.

He would have to apply for an unmarried spouse visa from outside of the UK. However, my mother would also be outside of the UK, as she is not currently resident here because they reside together in New Zealand. In this case, how might she prove that she is able to meet the requirements for sponsors, i.e. accommodation? I understand the visa process generally, but not how requirements are met when both people in the relationship are outside of the UK.

To meet the financial requirement, they can use savings if they have at least £62,500 or her overseas income if she works and it meets the £18,600pa requirement AND she has a job offer to start working in the UK within 3 months at the same salary level.

Accommodation can be with friends and family initially if they have or booking short term accommodation initially.

Hi, yes, he does have a UK-born grandparent. As I understand it, however, those who come to the UK on an ancestry visa must be able and planning to work in the UK. He is retired.

Hello,

Thanks a lot for your help thus far.

I've encountered further unknowns re. SET05 visa, despite my having done quite a bit of research on it.

Questions:

My parents are able to meet the minimum maintenance requirement of £62,500 (after their house was, sadly, razed to the ground in the Christchurch, NZ earthquake).

Though, for how long must they have had that minimum amount in their bank account?

Must this amount be in the applicant's account, or the sponsor's, or is a joint-account sufficient?
