Hi All,

I’m working in he U.K. under dependent tier 2 visa. I’m pregnanct and have passed the qualifying week and therefore if I was to stay I was entitled to receive SMP.

Me and my husband have decided to leave the country and therefore I will probably lose my visa before labour.

My question is - by losing the visa am I also losing my SMP? I know that even I quite the job I stoll should get the SMP, but what is the case if I lose my visa? Does my employer have/can still pay it?

SMP is paid by your employer while you are an employee. If you leave your job and the UK, you lose the SMP.
