Tier 2 Migrant is applying for ILR - What should their dependant do?

Post by AKH89 » Fri Aug 31, 2018 5:07 pm

Dear members

My current visa (Tier-2 General) is expiring in two weeks and I will be eligible for ILR (Tier-2 General, 5-year route) next week. So I am making an ILR application once I am eligible next week just before expiry of my current visa. My wife's PBS Dependant visa is also expiring on the same date as mine, but still unqualified for making an ILR application.

I know that she should extend her PBS Dependant visa until she will be qualified for ILR. However I do not know what documents she should include with her application to show that she is a dependant of a person who is currently applying for ILR. Does she need to apply online? Can she ask for a 6-month extension or should it be 3 years?

Many thanks

When you apply ILR and waiting, her extension application will also be pending until your result. If you successful, she will extend for 3 years. If you fail, she will be refused as well.

Her extension application will also be online.

Thank you for your response!

If it takes several months for my application to be processed, and my partner becomes eligible for ILR, what will happen then? I think I should apply with premium service to get same day decision to avoid this sort of complication.

Can I book an appointment with a premium centre first, pay the fee, etc., and then fill in the paper Set(o) form, bring the form and other documents to the centre? (and if approved my partner applies online)

Thanks

Should my partner use the "Tier-2 General" online application form? (Her visa is PBS Dependant!) Would you be able to provide a link to the online application form?
What length should she request on the form for her extension? Three years?

Thank you!

ILR online application

Post by AKH89 » Fri Aug 31, 2018 10:59 pm

Hello

Tier-2 General
Entry clearance: 25 Sep 2013
First entry: 09 Oct 2013
Current visa expiry: 14 Sep 2018

My questions are:

1- Have I been qualified for ILR application from 28 Aug (i.e. 28 days before 25 Sep 2018), or will I be qualified from 11 Sep (i.e. 28 days before 09 Oct 2018).

2- Would it be OK if I make an online application on 12 Sep (which will be within the 28 days period) through https://visas-immigration.service.gov.uk/product/set-o and then book an appointment at a Premium centre in October (which will be about one month after my current visa expiry) to complete the application?
(There seems to be no PSC appointment available before my visa expires)

Any advice would be much appreciated.

Thanks!

You must apply in person before your visa expires. If you cannot get an appointment, you will need to apply by post.

You have left it very late to find appointments.

Thank you for the advice!

I had to - because I’ve got an extension of my employment just two weeks ago.

Would you please kindly direct me to the form that my wife needs to use for an extension of her PBS Dependant visa? Because she is still below 5 years. I have not been able to find the online application form for her. In the “family members” section of “Tier 2 General” (link below) there is no link to the online application form for dependants applying in the UK!

Thanks

Really??? Did you scroll down the page and look and click on PARTNER???

Dependants applying in the UK on their own

Your dependants can apply to extend or switch their visas to stay with you if they’re already in the UK.

Your family members can apply online if they’re your:

Please help!

Payment made, appointment not booked!

I planned to make an online application and send my documents by mail to UKVI as my current visa is expiring soon (14 Sep) and I was not able to find a PSC appointment, but this afternoon I just checked the PSC appointments once again and found one at Croydon for 13 Sep and tried to book it. The payment was successful but the appointment has not been booked! I've got a confirmation email, confirming the payment and that "The time taken to make your payment was too long and your visa appointment has expired. You must book a new appointment". But when I log in to my account (Premium Service Appointment Booking) I am on the last page, i.e. "Download and Print" and not able to see the appointments at all!

I contacted UKVI customer service enquiry line and they said I should claim a refund which takes about 6 weeks! My current visa is expiring on 14 Sep and I have no money left to make an online application before then as I have already paid £3074 to UKVI today which will be refunded 6 weeks later! :=))

What would you do in this situation?

Thanks
