Marrying a failed asylum seeker

A male friend of mine is planning to get married to a woman who is a failed asylum seeker.

The male is a British citizen. They've just had a baby. They are planning to register the birth together.

1- how do they go about getting married?

2- Can they just give notice to the Registry Office and get married?
3- what are the possibilities for the partner who is currently supported and accommodated by Social Services to get her immigration status sorted out?

Any advice on this will be highly appreciated.

Having a baby or intending to get married will not regularize immigration status.

They are in for a long, bumpy and expensive ride.

How long have they been in a relationship?

How long has your 'friend' been in the UK and why was the asylum application refused? What is his nationality??

1- how do they go about getting married?

They have to give 28 days notice in the usual way at an HO approved Registry Office, with identification.

2- Can they just give notice to the Registry Office and get married?

28 days notice as stated in #1 above. The registry office then has to inform HO and this notice period can be extended to 70 days for HO to investigate and/or interview each of them separately before possibly granting permission to marry. Your friend risks being detained at this point or if approval is given, on the wedding day.

3- what are the possibilities for the partner who is currently supported and accommodated by Social Services to get her immigration status sorted out?

A long, hard and expensive process for your friend. Just marrying a British citizen gives no rights or status.
