1. Little difference. Unfortunately, they don't grant ILE to spouses anymore.

2. Husband residing in the UK with leave as a spouse for at least five years.

Thanks vinny for your reply.

If my husband lives for 5 years but during that time he gets a job outside the UK. Will his residency be effected ?

Sorry didnt know that was a link ! I read it now but still confused

Indefinite leave to remain (often known as 'ILR' and 'settlement') is permission to remain in the UK without any time restrictions on the length of stay. It is not the same as naturalisation as a British citizen and may, in specific circumstances, be ceased or invalidated, for example, if a fraudulent application is uncovered, if the person resides outside of the UK for more than 2 years or as a result of a criminal conviction that results in a Deportation Order coming into force.

Does that mean that if my husband entered the UK then left to work outside UK for 2 years or more then he will loose his ILE ?

Is it 2 years within the 5years period?

Do they count it as 2whole years or the absence can add up to 2 years .

Can you please simplify it for me

Your husband will NOT get ILE. He will get a 2.5 year spouse visa. Then renew for another 2.5 years before he can apply for ILR.

He needs 5 years residence to qualify for ILR. Proof of subsisting relationship and cohabitation is required for the visa extension after 2.5 years and for ILR.
Do they count it as 2whole years or the absence can add up to 2 years .

ILR/ILE is lost if absent from the UK for 2 years or more.

However, for a spouse visa, he is expected to be resident in the UK to qualify for ILR. Just holding a visa for 2.5 years x 2 and working and living abroad is not sufficient.
