Tier 2 dependent ilr eligibility

Post by RJLK » Sat Sep 08, 2018 8:57 am

Dear all,

I have a query regarding my wife's ILR eligibility.

My wife's initial tier 2 dependent visa was granted (outside UK) on July 2013 which was valid until Dec 2014. She stayed in the uk until April 2014 and left the country for delivery. I (Tier 2 Main) got my second extension with the same employer from Nov 2014 to May 2015. So I didn't apply for my wife dependent visa as she was not in the country. Then I changed my employer on May 2015 and applied for her dependent visa (outside UK). She arrived on July 2015 and collected her BRP from the postoffice which was valid until Apr 2018. Now she has got another tier 2 dependent extension until 2021.

In short, my wife's visa details are
July 2013-Dec 2014 - tier 2 dependent visa (applied outside UK)
May 2014 - Left UK for delivery
July 2015 - Apr 2018 - tier 2 dependent visa (applied outside UK)
July 2015 - Arrived the uk.
May 2018 - July 2021 - tier 2 dependent extension visa (applied in the uk)

I think she is not eligible for ILR as she was away for around 14 months (May 2014-June 2015) and she did not have any dependent visa from (Jan 2015-June 2015). I think she is eligible for ILR on July 2020. Could you please let me know my understanding is correct.

Thanks,
RJLK

Yes, she qualifies for ILR in 2020.

Here clock reset when she applied for a new entry clearance visa more than 28 days after the last visa expired.
