ILR continuous period calculation

Post by DBGR » Sun Sep 09, 2018 8:11 pm

Hi,

I am preparing my ILR application and would appreciate your views on when I would be eligible to apply for ILR.

While I was outside the UK, I have got Tier 1 General visa granted in Mar-11 and renewed in Mar-13 (came to the UK for 2 weeks for renewal and flew back). I came back to the UK to work in Aug-14 on Tier 1 General visa and am in Tier 2 General since Jul-17 till date.

Would I be eligible for ILR from Feb-19 (i.e., Aug-19 minus 180 days) or would I be eligible only in Jul-19 (i.e., 28 days before my 5th anniversary of landing in the UK)?

In other words, would my absence in the UK up to 180 days can be counted as part of ILR continuous period as long as I had valid entry to leave?

Looking forward to your views.

You count from when you entered the UK as it was more than 180 days after your visa was granted in 2013.
