Naturalisation of non-international adoption

Post by Tkas » Wed Sep 12, 2018 10:38 pm

I adopted a child from Thailand as a Thai person through Thai law. I have dual nationalities, Thai and British. The child is now in the UK on tier 4 student visa. With this kind of adoption, is my child eligible for British citizenship? If so, how do I begin the process?

Read the link below. Not sure if Thailand is signed up to the Hague Convention for Adoptions.

Thank you for the link. Thailand is a part of Hague convention adoption but my understanding is the Hague convention is international adoption. I adopted the child as a Thai person adopting a Thai child, so I don’t know if it counts as a part of Hague convention.

Likely then that point 3 - Other Adoptions applies to you and the child would not be automatically British and you would need to register the child on form MN1 and pay the fee if all the requirements stated in point 3 are met.

You don't state where you usually live, ie Thailand or the UK.

Also, is the child you adopted unrelated through blood to any other family members, i.e. not a sister's child or cousin etc you adopted?

I live in the UK full time. The child is related to me, he is my nephew. He lives in the UK too but on student visa as he needed to start school while the adoption was in progress.

Does this mean the procedure is different as the child is related to me?

How old is the child?

How old was the child when you adopted them?

What category of student visa does the child hold?

What was the reason for adoption, i.e. where are the childs biological parents?

He is 11 now, I adopted him when he was 10. Reason for adoption is because he was living in a bad environment with biological father (my brother) i.e. drugs, physical abuse. I do not know where the mother is. She was not seen for many years.

The child is on tier 4 student visa.

So, does the fact that the child is related to me change the naturalisation procedure?
