Awaiting BRP and more than 4 weeks unemployed

I am currently employed by the NHS however I have a new employer under a different job however still thesame Tier 2 visa.

My current leave expired on 28 August 2018, I have accepted the job offer for my new employer 2.5 months ago and until now they still haven’t given me my CoS. I have until friday to submit it as the 27th of August is a bank holiday. I am just really anxious and worried because I am in no control over this. I have complied all they required of me and yet the reply they gave me tegarding the CoS is they are just waiting for documents or they have been checking the draft and putting some comments on it. Seriously? For 6 weeks they have been doing that?

They don’t seem to get the urgency of it eventhough I have been following it up almost daily. They seem to get annoyed when I ask for updates. Worst is I have a husband dependent on my visa so his work is also affected. To add, This is my 4th year in the UK and I would be eligible to apply ILR next year but if I won’t be able to submit it on time, will it have an impact on my application for IlR?

I just want an advise on what to do incase the employer would still not produce the CoS for me to submit my application for extension of tier 2 visa

You have to maintain continuous valid leave to qualify for ILR. Unfortunately getting a CoS is completely up to the employer so following up with them is your only recourse.

You might want to consider asking your current employer if they would extend your visa with a CoS.

Unless of course you already resigned??

I have already resigned as the current company kept on reassuring me since 4 weeks ago that my CoS is on its way. Today, they said my CoS has been approved and they will send it to the third party agency that processes the visa.

However, my recruiter said that if something happens, they will just courier my passport if I need to leave the country. If only I knew, I wouldn’t have left my current employer. They were so reassuring and told me not to worry and now this happened!

If you leave the UK, you will be subject to the 12 months cooling off period before you can come back on tier 2 general.

That’s what I don’t want to happen. It will also affect my ILR application.

I read about the 14 days grace period after the visa expiring. Is it still thesame case?

Can someone give me a light on this. I am still and currently waiting for my Visa (BRP Tier 2 Sponsor) to arrive. I left my previous work 24th of August and I have been given a sad news by my employer that I won’t be able to start training next week (17th September) as it’s too late. The more disappointing news is the next training will be on October 1.

Will this be considered as unpaid leave? I know we are only allowed 4 weeks. And if I start October 1, it will be more than 4 weeks by then.

Received august 28. Then approved last september 11. I applied by post. Still awaiting for my brp

What date did you post your application?

A BRP can take 7-10 days to be delivered. Your application, according to you, was only approved 2 days ago (presumably you got a letter?).

Your BRP start date will be any time after the 11th if that is the date your application for the visa was approved.

Not sure why you think there is a 4 week 'absence' issue. Simply ask your sponsor to adjust your start date in the SMS system.
