British Citizenship – Good Character and Convictions

Post by sunny26 » Wed Sep 12, 2018 2:50 pm

HI guys I have been so stressed about this requirement in the naturalisation process and need your help.

I gained ILR in 2005

I was convicted of robbery in 2002 - Juvenile offence (I was 16 at the time and it involved a mobile phone) - they gave me 60 or 100 hour community service and a fine of £250

further offences were driving without licence and insurance 3 times - last one in 2007

Caution 3 times for possessing marijuana (very small amount - ie. a joint or so - I don't even smoke now and this was just a silly adventure when I was young) - last one in 2010

Now I have moved on to do graduation, and currently doing a Post graduate degree (Masters).
I have exemplary references from local charity working with vulnerable adults (similar to CAB, providing professional advice and representing at tribunals).

I have done my enhanced DBA check and have done SAR many times. My problem is that the only offence showing on them is the robbery which took place 17 years ago there is no mention of cautions or the road traffic offences (even on the enhanced DBS check). the DVLA say they have no record of the road traffic offences and nor do I remember the dates or the fines that were given.

Question 1 - DO i declare all the offences even though they are not showing on my enhanced and SAR checks?
Question 2 - If so, what are the chances of me getting naturalisation?

question 3 - what level of checks does the immig do? standars enhanced or local PNC checks also?

Guys please help. AMber I have read the thread and as my situation is so nique I failed to get an answer. I have noticed how you have helped so many, so your help in the matter will be highly appreciated.

Amber is no longer active on the forum.

I have also split your post to its own topic as you are likely to get a better response than tagging onto the other lengthy general topic.

As I understand it the Rehabilitation of Offenders Act is not applicable for naturalisation application, meaning that all convictions have to be declared. The AN booklet gives guidance: https://assets.publishing.service.gov.u ... feb-18.pdf
Question 1 - DO i declare all the offences even though they are not showing on my enhanced and SAR checks? Yes
Question 2 - If so, what are the chances of me getting naturalisation? Review the guidance

question 3 - what level of checks does the immig do? standars enhanced or local PNC checks also? Nationality is not immigration. Don't know what / how they do these checks. Clearly the Home Office has many soucres at their disposal
Remember that not disclosing conviction may count against you, i.e. withholding material facts.
This is just my opinion as a member of this forum and does not constitute immigration advice.
