Dear all,

I have a Tier 2-related queries and I would appreciate if someone with relevant knowledge/experience could clarify.answer

I have a Tier 2 for 27 months as a doctor with the same sponsor. Recently, my contract has expired prior to finding a new job (31/07/2018). That is being said,NO curtailment letter has been received thus far. Since then, I've been looking for another job and fortunately, the quest has been successful. The CoS has just been applied for by the new employer on 13/09/2018 and I am not quite sure when it would be issued

In the interim, I'm intending to travel outside UK to visit my family to make use of time plus the fact it would be very difficult for me to travel for the next 4 months giving the tight work schedule. However, I'm not quite sure whether this would be a safe undertaking. Thus, I thought of the two options, first is to travel now and try try to return within 2 weeks and the second would be a later travel after securing the new visa (plan to apply via the premium service). However, time, cooling off period (if visa expired whilst abroad) and visa validity are unclear and making me uncomfortable and hesitant as well to decide which path should I pursue.to make a decision as I do not want to to turn the the tide

Needless to say, knowledge of these factors would guide me and help make an informed decision. Thus I would e very grateful of the following three questions could be answered

1. How long it will take for the CoS to be issued giving the fact that it is now unrestricted for doctors/nurses as per the new Tier 2 guidance? Would it be reasonable to anticipate this could be sorted out within one week?

2. Giving the current circumstances (not sponsored currently, though no curtailment notification has been received). Can I travel outside UK and return 2 weeks later?

2. Assuming the answer to to Q2 is Yes, what would be the situation if the curtailment letter has been sent to to my address whilst I'm away? Can I return to UK anymore giving the fact that I left prior to my notification?

If you are applying within the UK to change sponsors, the CoS process is not part of the monthly restricted Cos monthly allocation process and meeting. Your new sponsor simply assigns a UCoS to you if they have available ones to assign and you apply for your visa.

Personally. I wouldn't travel. You do risk being refused entry and your visa canceled as you are now longer employed.
