Long residency

Post by imi99 » Fri Sep 14, 2018 10:13 am

Hello everyone. A question regarding long residency. My brother came to uk on a student visa in 2007. Then changed to psw ( valid till dec 2012). In march 2012 while on psw he went to pakistan and made an aplication for hsmp dependent. Visa granted came back with in April 2012. Then went on a spouse visa after his wife became british. Now he wants to make an application for ilr on basis on long residency.
My question is when he went to pakistan on psw and made an application for hsmp dependent, would that be consider as break in continuous residence? As he made application out of country and applied for entry clearence as hsmp dependent? :!:

Even though he went out of the country and made entry clearance application for tier1 dependent ( while he had a valid psw)

Correct.

Please read the long residence caseworker guidance for information.
