Please Need advise about Toeic clarification

Would highly appreciate if anyone can help with my cousin husband situation I’m sorry if this has already been discussed.


Her husband situation:

He applied for spouse visa with TOEIC certificate (no proxy) in February 2014 and his application was successful.
In July 2015- Home office called him for an interview, so he attended for an interview (all question was about TOEIC)
2016 Applied for FLR M Extension successfully got his Extension.

She is quite worried If he applies for ILR or naturalization will they raise the Issue for TOEIC again?
So recently she requested HO SAR about Toeic interview.

A couple week ago so they have received SAR reports as following

Do not Casework? Referred for interview
Description About schedule and attended for interview….
Outcome: Credible
Credible case returning to ETS taskforce Sheffield
Interview credible? ETS marker closed.



PlEASE Need advise about Toeic clarification does she need to attach Toeic SAR report along with his (Set M) application form?

Any help would be greatly appreciated.

I think your cousin's husband is over-worrying for nothing and she/he can save that worry for other purpose because if her toic test was previously accepted on two occasions then why would it be problematic now. But I think now the rules have been changed regarding English proficiency test and she will have to pass B1 test for ILR unless he has passed a degree from UK university.

He already passed his B1 English language test from Trinity college and Life in the UK test.

He done Master's degree taught in the UK, IELTS for life skills and He also did Toeic but never use toeic any application before. As (ii) the qualification was taught or researched in the UK or a majority English speaking country (other than Canada) He knows didn't need to but still did it!

The main problem is my cousin she attached to his first application!
That is the reason she is quite worried If he applies for ILR or naturalization will they raise the Issue for TOEIC again?

The reason for asking the question is that most of the people are refused based on 322(5).

I would be very grateful if you reply, please she needs clarification about SAR report does she need to attach Toeic SAR report along with her husband (Set M) application form?

Sar report is not need to attach as its just HO immigration record about a particular person which the concerning person can request under freedom of information. I guess the fear you feeling about is the good character requirement which need to be successfully be cleared for naturalization and there that toiec issue might arise. But more likely it won't as the person has already got two extensions.
