Can I study while my apeal is pending?

Post by Shanr » Mon Sep 17, 2018 11:44 pm

Hello everyone!
So basically I came here in UK as tier 4 student in 2012 and studied till degree and married my british wife end of 2017, applied my flr(m) couple of days later and got refused with no in country apeal, did PAP and got in country apeal right and now my apeal is pending, so my question is can I study a new course in new institution while my apeal is pending? as the course advisor said if home office can confirm that I can study they will admit me into the session. I was a student before I applied for spouse visa with no working rights. Please help

Regards

It sounds like you have gone down the JR route. During the JR process, you do not have leave to reside in the UK and are technically an overstayer. Therefore, I doubt that you can study a further course.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

No its not JR, as we have done PAP, home office asked for 3 month to reconsider my applocation and we had sent them all the additional evidence we had but they still refused the application and continued my 3c leave and given me in country apeal right. So technically I have 3C leave, they have even mentioned it in my refusal letter.

You given reply to yourself. You really have to make sure that whether you are covered by section 3C because a lot of HO issued letters gives information generally which are not addressed to applicant rather a generic guide.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
