Need help with application

Post by Inspiron1001 » Tue Sep 18, 2018 11:38 am

I would really appreciate any help provided regarding my application. I have been married to an Irish national and I happen to be on a Pakistani passport myself. The visa change that came after getting married was a "residence documentation" sticker in the passport, valid until 2017.

I then applied for a Residence Card, which at the time of application I thought would be a Permanent residence card however that was not the case as it has an expiry date and does not mention PR card either. My first question is as follows:

1) the residence card expires in 2022. Can i not apply for PR card till then?
2) what is the criteria to apply for a PR as I was under the impression I would get one after 5 years of being married when I applied for a Residence Card.

Furthermore I then applied for citizenship with the same card and as it turns out, it was refused because I should have had a PR before. My dilemma as it stands is not having realised I was sent a RC instead of a Permanent residence card.

Where can I go from here and what are my options as I really need to clarify this.

What has your spouse been doing since you came the UK?? Working, studying etc.

For you to qualify for PR, your EU spouse must be a qualified person exercising treaty rights.
I then applied for a Residence Card
Which form did you complete? If you applied for another RC, then it is not PR as PR is a separate form.

She has been living here for over 30 years and has spent literally all her life in England. Wouldn't that be considered as being qualified ?

To my knowledge I filled out a form for PR as I needed to be living with her for atleast 5 years before qualifying or that isn't correct?

Simply 'living' in the UK is not sufficient.

What documentation did you submit with your 'PR' application?

At the time in 2017 when I applied, it was mostly her paperwork as supporting documents as she was the sponsor. The form you've sent in the link is different to the one I filled out.

Can I now apply for PR straight away or do I have to wait till 2022 as mentioned on the residence card that I have.

P.s I also called home office European section and they said I need to wait till 2022 whereas on the website it states I need to be continuously living here for 5+ years so which one is it ?

When completing joint PR Application for eea and Non eea family member married
On biometric section, does the EEA national sign as she is the main applicant or Non EEA national need to sign ?
Just bit worried as my solicitor advised me to get it signed by EEA national as she is the main applicant
