How soon can I apply for Tier 2 dependant Visa

Hi,

I got my ILR in March 2018 through Tier 2, and my wife who is current on Tier 2 dependant visa is due to renewal in November.

How soon can I apply for a PBS dependant visa i.e. can I apply now or should I need to apply within 1 month from the expiry date?

Any help is much appreciated.

Thanks for your reply.

What did you mean by she meets the requirements, I.e. Her visa runs out on 29th Nov 2018, should I need to wait and apply any day between 29th Oct and 29th Nov. or can I apply in September itself.

And the next question is my wife got her first tier 2 dependant visa on 5th Sep 2017 and expires on 29th Nov 2018, I have got my ILR until 2024, so will she be given only a 3 year extension or any chance I can apply for 5 years?

Meets the requirements, i.e. proof of cohabitation and 90 days maintenance funds. She can apply at any point.

She will only get a 3 year extension. There is no option for her to apply for a 5 year visa.

No, you need more than one item to prove cohabitation and subsisting marriage for two years or however long she has been in the UK. Look at page 63 and 64 of the FLR(M) where it lists examples of what HO considers and expects to see for cohabitation. Note this is NOT the form she uses, I am only linking it for the examples listed.
