I am trying to understand the requirements for ILR for my wife, she is currently on Tier 2G dependent visa. I have provided a brief background and listed my queries below. would be grateful if people can guide / share their experience.
Brief background:
- I am on ILR (via Tier 2G route)
- Wife's Tier 2G visa first stamped on 1-Jun-14 (from outside of the UK)
- She entered the UK on 7-Jun-14
- Since then, there have been couple of extensions due to my employment switch and her current Tier 2G expires on 31-May-19.
- She has been outside of the during this period on & off but a) her total absences to date are 200 days and only one of these were 90 days long (in a stretch), all others were between 2/ 3 weeks max.
with this in mind, i have listed below my understanding and some of the queries i have and would be grateful if anyone could confirm if these are right or not.
1. For 5 year continuous residence requirement, i should calculate her 5 year period from the date she entered the country as she is a PBS dependent?
2. Assuming 5 year count down starts from the date of entry, she will be eligible for ILR (based on 28 days rule) on 6 Jun 2019?
3. Given the recent changes in the absence rules, her absences will only count from 11 Jan 2018 onwards and all absences prior to that date:
3a) will not be relevant for her ILR application? and therefore not required to be reported?
3b) wouldnt count towards 180 days rule applicable from 11 Jan 2018?
4. In addition to usual supporting evidence like marriage certificate, what other docs i need to provide with her ILR application?
5. Since my ILR, i have moved on from perm employment and started my own business:
5a) does that matter i.e. do i need to report that with her ILR application?
5b) do they need some sort of employment/business reference letter for my job?
