1. It is your sponsors responsibility to inform HO that you are no longer employed with them. They need to do this within 10 days after your last day of employment. It is clearly mentioned in the Sponsorship guidance notes.

2. That is outdated. You do not have to return your passport and BRP to HO.

Hi everyone,

I was made redundant recently. My employer told me that I should inform the home office about it before I was made redundant. However, I'm not quite sure about it after reading people's experiences online.

1. Can anyone please confirm that if it is the sponsor's(my employer) responsibility to notify the home office about my redundancy?

2. When I first received my tier 2 visa, there was a letter from HO as well saying that:

"If your employment ceases prematurely you must return your passport and BBRP to the HO within 28 days in order for them to update your records. If you do not submit your passport and BRP we will update our records with the information held on file."

Based on this, should I send my BRP and passport to HO?

3. If I don't need to inform HO, how much longer can I stay in the UK before I find my next job?

3. There is no set time limit. When your visa is curtailed though, you will only have 60 days before you have to leave the UK. Curtailment letters can take a few weeks to a few months to be sent to you.

Thank you very much for your help. I guess I should let my previous employer know that they need to inform the HO since it seems that they didn't know about it.

If I understood correctly, I don't have to do anything and can keep looking for jobs right?

I just realized that my contract ended on 8th Sep, it's been over 10 days by now. I'm not sure whether or not my previous employer has informed HO yet. If they haven't, would they be in trouble? Would I also be in trouble if they were punished because of me?

No, should be fine provided you still have a valid visa.

Thanks a lot for your answers earlier.

If for the worst scenario, I couldn't find a job before my visa expires, I would have to go back to my home country. If that is the case, I would like to claim my tax back(I started working from 2017 Sep). On the government's website, they said:

"Tell HMRC before you leave

Sending your tax return
You can’t use HMRC’s online services to tell them you’re leaving the UK. Instead, you need to:
  • send your tax return by post
    use software
    get help from a professional, such as an accountant
Complete the ‘residence’ section in your tax return (form SA109 if you’re sending it by post).

You’ll be charged a penalty if you don’t meet the deadline - it’s earlier if you’re sending your return by post (31 October)."

My questions are:
1. Do I have to tell HMRC by post since they have online options? https://www.gov.uk/tax-right-retire-abroad-return-to-uk
2. If yes, is the deadline 31st Oct 2018 since I'm not self-employed, nor a partner? https://www.gov.uk/self-assessment-tax- ... /deadlines
3. Do I have to register for self-assessment first before I claim my tax back?
