Hi All,
I am currently on EEA2 visa which is coming to expire in April 2019. My partner (Civil Partner) was from EU but just accquired his British citizenship this month.
My questions are: can I apply for British citizenship today since my partner is already naturlised or do I have to apply for permanent residency first and then the citizenship a year after. If I must apply for the permanent residency, can I apply now before the expiry runs out. We are traveling outside of EU in April and now concerned it might be an issue coming back in the country.
Thank you.
Kind regards,
W

You need PR before you can apply for citizenship.
You also need 5 years residence on the EEA route before you can apply for PR and you don't state any of the important UK application/entry dates or your UK Immigration history.

Hi CR001,
Thank you for your reply.
I was on a student visa 2010-2011 and for the next two years I was on post study work visa. Currently on EEA2 since April 2014. Our civil partnership ceremony was held on January 2014.
I read it somewhere where people say once the partner is naturalised, I could potentially acquire my citizenship based on the fact he is now British and we are already in partnership for almost 5 years (I think the minimum requirement is 3 years)
Thank you

Our civil partnership ceremony was held on January 2014.
My understanding is that your start date of the qualifying period is this one. So you can apply for PR exactly 5 years after this date

Yes, but you need PR first before you can apply for citizenship.

Understood. Thank you.
Once I have the permanent residency, in which time frame, I could apply the British citizenship please?

You can apply as soon as you have PR, citizenship will be based on 3 years Civil partnership, provided you meet all the requirements including Life in the UK test, English B1 from an HO approved test provider and that you were physically present in the UK on the same date you apply as 3 years ago. You also have an absence limit of no more than 270 days in the 3 years and 90 days in the 12 months immediately before applying.

Thank you. You have been extremely helpful.
Another question I have is: am I still using the EEA route or not, considering my partner is already naturlised. The reason why I’m asking is I think I would like to use an express service at Home Office to have the PR approved (we are traveling in February as well) but I think this service is not necessary eligible to anyone.

There is no express or premium service for EEA route applications. It is postal only.

Exactly. That’s my actual concern. With the postal service, it could take months before I receive my passport back and I will have extensive travel plans in the coming months.
With my partner being a British citizen now, couldn’t I go via the British’s partner route?

No, because you don't hold a visa in that category, i.e. a spouse visa issued under the UK Immigration rules.

Bit concerned if I would be able to get my passport back in time.

How long could it take before the PR card is issued?
I understand that I could always request my passport to be sent back during the process?

Sorry questions keep coming in.
As you mentioned earlier, I could apply for citizenship once I have my PR - could I then apply for it online without sending in my passport or even better with the express service so I could the passport back in time.

If you apply online and use the NDRS service at the council yes.
There is no express service for citizenship either.

hi
When I apply for British citizenship right after I receive my permanent residency- which documents would I need to present in order to apply for the citizenship straightaway? I mean do I have to provide any document of my partner that he is already naturalized? How could home office know that I don’t have to wait for another year.

Yes you have to provide evidence of your partners citizenship if you want to be exempt from waiting 12 months on PR.
HO knows the rules and difference between a Sectioon 6(1) non British spouse/partner application and a Section 6(2) British spouse/partner application!!!

Hello is this the right place to ask a naturalization question.
My partner has a Residence Document blue form and has been working with some short gaps between work - will this affect the 5 years continuous employment required for PR?

No it is not. This is not a 'general discussion' topic

Please continue in your existing topic you already have or start your own topic regarding PR questions.

I just came across a question regarding when my fingerprints were taken as part of a previous UK immigration application made ..
Quite frankly I don’t remember the dates - and also I was on Post Study work Visa prior to my student visa .. should I include both? Are the immigrantion officers expecting an exact answer?

Only till recently I came across someone on this forum applied and received PR for his sister in law as extended eea family member. Does it mean the sister in law come in to the country as part of the family member? Had she also have to live here for a continued period of time too?
Would it be possible for me (non eea who is in the process of getting PR) and my EEA partner (who is now naturalized) to get my mother to live with me on a more permanent basis, she is getting older and long haul flying is getting tiresome for her.
