Tier 2 ICT dependent to Tier 2 General

Hi,

I am Indian citizen with UK ICT long term dependent visa. I came to UK in 2016 and working since 2016 April in UK. Now my employer is ready to sponsor me Tier 2 general Visa, but I wanted to understand the actual process:

1. Do i need to have cooling period of 12 months?
2. Do I have to go back to my home country to get my visa switched from Tier 2 ICT dependent PBS to Tier 2 general?
3. How long does the process takes?
4. What is the total fee for application for me as main applicant and my husband as dependent.

Please let me know.

1. No. Cooling off period DOES NOT apply to dependents changing to tier 2 general main visa holder.

2. Yes you must apply from home country. You cannot switch within the UK.

3. It can take anything from a couple of weeks to a couple of months.

4. https://www.gov.uk/tier-2-general PLUS you have to pay IHS fee, £600 each for an upto 3 year visa for example.

If i am sponsored and i apply from UK. My husband is currently on Tier 2 ICT long term visa. but once i get my visa done. he will be my dependent, so will he be having cooling period to switch from Tier 2 ICT to dependent?

You cannot apply in the UK. You must apply from your home country.

No, the cooling off period DOES NOT apply to either of you. It is ONLY applicable to ICT main visa holders wanting to apply for Tier 2 General main visa.

Thank you, last question.
Since there are limits on employers to provide number of sponsorship. on each license how many sponsorship can be provided? Also how frequently does the number of licenses get updated. Any idea?

It differs from sponsor to sponsor and what their requirements are etc. No one on the forum could possibly answer that question. Have you seen how long the sponsorship list actually is??

Also, bear in mind that the process for Restricted CoS for applications outside the UK is very different to the process for extensions or changing employers within the UK via Unrestricted CoS.
