After IHS Partial Refund

Tier-1 (Enterpreneur) Extension

Hello Friends,

My Tier 1 Enterprenuer to ILR (Accelerated Route) application got rejected because of two reasons:

1. Somewhere in the form they asked whether the jobs created, Are full time employees or I wish to combine the jobs and I ticked full time. These 10 job were 120 Hrs a weeks for 52 weeks but they found some shortfall somewhere for four employees and refused it and accepted only Six.

2. When I came to UK invested in excess of 200K in different companies. They could find the investment of £130 in the Financils but not the balance amount.

Scored all other relevant Points for Director, registration etc.

Went in for AR and they said, now we did a mistake and you don't have six full time employees but three.
Gave them documents showing investment but again refused on the basis that no new evidence was accepted.

Looking at this decided to go in for extension for two years rather than ILR.

My question to you is:
1. Since they have done the working on the file and have agreed on three employee & other points will that make the processing any faster as supported and agreed on AR refusal & previous refusal.
2. For the Investment I have following line added on the column of Share capital" During the Year_____the company issued £____ shares to Mr. ________for an investment of £________.

Supported with Accounts letter+Money In Bank Statement + Co. House SH02.

Please suggest if I need to anything more on the Financial / Supporting.

The requirement for full time is 30 hrs/week, which works out to 130 hrs/month, not 120.
To your questions:
1. No, they have to consider it as a totally new application. It works both ways, if you had something negative in the 1st application, you would prefer it to be treated on its own and not influenced by the earlier decision.
2. Assuming that line is the accounts it should be fine. Was it not there in your first application ?

You are right I meant 30 Hrs a Weeks for 52 weeks in Year and thats how they agreed on three employees.

Yes, this line has been added now.

However, in my ILR application I added the Companies House Certificate Confirming investment and as per the Guidelines :

"If you invested by way of Share Capital, the business accounts must show the shareholders, the amount and value of the shares (on the date of Purchase) in your name as it appears on your application. If the value of your share capital is not shown in the accounts, then a print of the company register of member from Companies house must be provided"


And Co. House Certificate along with Accountants letter confirming investment was given.

My Question would be :

Now should I go in for another AR or Extension?

And will I need to have fresh BRP for Extension or will they consider the previous one I did for ILR.

You can only go for AR for ILR and it does appear you do not qualify. So, the chances of success in an AR is close to zero.

That means you need to file for an extension.

I am not sure what you mean by "Companies House Certificate". I am not aware of any certificate that would meet the requirement, which is very specific (register of members)

You will need to do your biometrics again

Dear Moderators,

My Essential Timelines are as under;

Applied for ILR on 11/03/18 (200K, No Team, On the Basis of 10+ Employment)
Bio Given 21/03/18
Refusal of ILR 16/06/18- (As per HO Pages of Investment were missing from the Financials, though had CA supporting letter)
AR done on 29/6/18
AR Refused on 27/07/18 (No New Evidence Accepted)
Tier 1 Extension application submitted on 11/08/18
Bio Done on 30/08/18
Partial IHS Refund 21/09/18

No Complex Letter received.


My questions would be:
1. Now what could be the next thing to expect from HO & by when?
2. Is there anyway to expedite the process as my passports are with HO for more than six months now.
3. Any way to track the progress?
4. When does the 8 week period starts from?

4. Usually from biometric date. Though not sure what 8 week period you are referring to. Tier 1 Ent extensions usually take much longer than that.

Could you please guide me what will be the best option, as I have a very important medical emergency to attend in home country (where my Widow Mom needs to undergo surgery), how could I expedite the process (I've found letters from MP is only cosmetic).

Though, I've informed HO about the same.

Unfortunately, if you have already written to HO requesting expediting and provided evidence of the emergency, there is not much more you can do.

You can ask your MP to write in on your behalf, write directly to the home secretary and so on.

There was one person in this forum who withdrew his application, travelled home and applied for the extension from there. It is a risky strategy but worked well in his case. That could be a last resort approach
