Date of application for ILR when applied in person through Premiere Service

Hi all,

I am really confused about the date of the application when it comes to 28 days before, Premiere Service Appointment and online application/in person paper form submission, even after reading a few posts for the similar topic. I really need to get the ILR as early as possible, would much appreciate if someone can help me here. Thanks a million in advance.

01/11/2013 is my Tier 2 (General) issue date. So, 28 days before the completion of 5 years would be some date around early Oct 2018. I realized people were discussing which date would be taken by Home office as Application date (to meet 28 days before completion of 5 years requirement) when you submit the application ONLINE: the date when you complete online application OR the date of your Premiere Service appointment. In hope to stay away from that confusion assumingly caused by online application, I went with Premiere Service - in person submission of paper SET (O) form path.

I managed to secure the booking on 29th Aug 2018 for the Premiere Service appointment on 10/10/2018 using url: https://www.gov.uk/ukvi-premium-service ... ppointment.

However in the PDF attached to the booking confirmation email, it explicitly reads: DATE OF APPLICATION: 29th Aug 2018. Does it already answer my question: the Date of Application is always the date when you booked/paid the Premiere Service (regardless online/in person form) and never be the appointment date? It will be really a bad news if that is true, not only because I have to cancel the booking, but also the fact that there is little chance I can get the decision in Oct. As many have already pointed out, Premiere Service is so busy that the earliest appointment date you can secure would be about 40-45 days from the date you looked at availability. Given it is the DATE of payment rather than the appointment that counts for Date of Application and my earliest eligible application date is around 5th Oct, does it mean I can only start looking at appointment booking after 5th Oct and the earliest likely appointment date I can secure would be about mid November or even later?

Lastly, for the supporting document that requires recent 1 month for validity, provided my above understanding is unfortunate but true, that would be within one month from the date of PAYMENT/Booking date, rather than Premiere Service Appointment date, right?

Please could anyone help confirm?

Date of application is the date of your premium appointment and this is the date you use for your supporting documents.

@ CR001 Thank you so much for your always swift and reliable reply. Much appreciated. I can't remember in which post, but I do remember I saw you reply to other post (or the posters refer to your reply) in which you suggested that "Date of Application is the date of online application submission NOT the date of Premiere Appointment booked as part of online application".

1. Since you suggested differently here, can I understand both of your answers are correct, just "Date of Application is the date of online application submission" applies to Online SET (O) submission (including appointment booking) path, and "Date of Application is date of Premium appointment" applies to in-person paper form submission at Premiere centre?

2. Since it will cause harsh consequence if I am wrong at understanding your answers or gov official guide, would you kindly confirm in my case (Tier 2 General issue date: 01/11/2013) my current booking made on 29/08/2018 for the appointment on 10/10/2018 is definitely fine, not violating 5 years requirement and no need to cancel/reschedule?

3. What really worried/confused me is in the PDF attached to the booking confirmation email it explicitly states: "DATE OF APPLICATION: 29 Aug 2018". So this "Date of application" in email PDF is not that "Date of Application" that matters and everybody talks about? Shall I really ignore it safely? Is there any UK official guideline documents talking about Date of Application in this situation that I can refer to?

Date of online application depends on the applications, i.e. for tier 2 it is date of online submission as it is for citizenship applications.

As the online forms are new and only introduced this year, many members have reported that date of application is premium appointment date.

I believe this was referring to the date you applied to book the appointment and not the date of ILR application because you haven't submitted an application form.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

Thanks once again CR001 and Djsuccess for your replies. UK Visa and Immigration support line has also confirmed the same: in my case it is the appointment date not the booking date.

Thank you for the advice and support - I've got the exact same issue, I'm getting eligible on 1/11/2018, so I booked an appointment for 09/11/2018 this midnight (28/09/18 at 00:01) and therefore the PDF download in my case is showing Date of Application: 28/09/2018 and now I'm worried what to do next.

@andyyang - can you please share the link/contact no of UK Visa and Immigration support line where you got the confirmation that it is the appointment date which matters not the application date in the pdf?

Also if you don't mind may I please request you to share your appointment centre location and the outcome of your application (I wish and hope it'll be successful)

It is the date of in person appointment as has been reported by many applicants who have had success applying in person.
