Child Citizenship after divorce

Post by surajdhall » Thu Oct 04, 2018 4:06 pm

Hi Experts,

I am British Citizen and a divorcee. My child (4 yrs old)is born out of country, has been on a dependent visa. My wife was also my dependent and she now left UK. I am now responsible for my child. Can i apply British Citizenship for my child? Also could you guide me to a link that guides me for the required documents.

Thanks!!

Are you the legal guardian of the child? Is s/he still in the UK?

Is your child abroad or in the UK? Your post is unclear.

Children born abroad require ILR and can usually apply for citizenship when one parent applies or is British and the otherparent holds ILR.

A child born abroad has no entitlement to register as British.

Thanks for information.

Yes. My child is born in india and is currently on dependent visa. Since i am the only parent of my child, can't she apply for British Citizenship? I am currently British Citizen, so i want to understand if it is possible?
I read, children less than 13 yrs can apply for citizenship, if the parent is either ILR or British Citizen? Is it true?

Thanks!

I couldn't find where i read. May be i am confused.

She was born in India when i was on Tier 1 visa and now i am British Citizen.
My daughter came on Tier 1 dependent visa and she is still on the same visa. Currently she is with my mother in India for last 7 months.
If she is not eligible for British Citizenship, i hope i want to wait for another 1 year(which complete 5 yrs) to apply for ILR.
Does the 6 months out of country rule apply to children? She is 3 yrs old.

Thanks!

No absence limit.

She must return before her visa expires.

She needs ILR first before citizenship.

You might need to prove sole responsibility for ILR as the other parent is not applying at the same time etc and presumably also held a PBS dependent visa.
