Switching from spouse visa to tier 4?

Hello.

I'm struggling to find information regarding my peculiar issue. I'm a non-EEA national who’s in the UK on a Spouse visa and just started my last year at university which is sponsored by my parents. Unfortunately, my marriage is falling apart.

Therefore, I'm thinking to switch back to a Tier 4 visa before my partner applies for divorce soon, so I can secure my studies. However, I cannot find any information about that.

Is it even possible to switch from a Spouse visa to Tier 4? If yes, where should I start from, can I do it from within the U.K. or do I have to return to my home country for the application and how long would the visa processing time be approximately?

I really hope that there's a way that would not interrupt my studies as my goal this year is to achieve first degree.

Not sure if you could get sponsorship and CAS for only the last bit, but worth a try I suppose.

You cannot switch within the UK. You need to apply from home country.

You can, that's not a problem. Assuming the course itself is one that can be sponsored under Tier 4.

Thank you both for your replies!

I have been in the U.K. for over 5 years now, however out of those 5 years I’ve only been on the spouse visa for 1.5 years. Before that I was on student visas for a language course, university preparation and then for university itself. So, yes my course can be sponsored under tier 4.

I looked into applying from my home country and that would surely be an option for me, provided that it is even possible to still get a student visa in my case? This is what I’m really not sure about unfortunately.

See my reply above. You will need to request a CAS from your Tier 4 sponsor.
