Lived in the UK for 12 years previously want to have longer visa now to help my sick daughter

Post by Indu Sharma » Sun Oct 07, 2018 7:39 pm

Hi,

I immigrated to the UK back in 1964 when I was 8 years old and stayed in London till 1979 continuously for 12 years. At the time I had an Indian passport but still had Rights in the UK. I had my primary school and higher secondary education in London and also had a National Insurance number and worked later too.

In 1979 I was working at Dept of Employment at Holborn as an Executive Officer and left for India for only 2 weeks. In India I was emotionally blackmailed and forced into an Arrange marriage at the age of 21. I was promised I could return to London but was stopped from doing so. My passports were also confiscated but one has been returned to me now. However, back in 1979I had no intention to leave the UK permanently.

6 years later in 1985 I was able to make a new Indian passport and was given a VISIT VISA to enter the UK. When making this VISIT VISA I was told to deny any prior residence in the UK by my husband, not wanting to loose the chance to visit my sister in the UK I complied. I have had 5 subsequent visits on Visit Visas with my husband since.

My daughter has married and settled in UK and is a British Citizen now. Due to a very tough pregnancy she has now ruptured disc problems in the spine. I have come to help her on a C VISIT VISA but can see that she can no longer cope alone with her 2 small children.

I would like to visit and help her for longer periods than just 6 months. I have no intention in settling permanently in the UK now having my home etc in India. But due to my past residency in the UK I feel I should be allowed to enter into the UK for longer periods to help my daughter.

Can someone please guide me as to what would be the appropriate VISA etc for me?

Many thanks

It doesn't work like that unfortunately. Your prior residency in the UK is lost. Absence of 2 or more years loses the right to reside if you held ILR.

You need to follow the same processes and applications for visitors which means not staying in the UK for longer than 6 months in any 12 month rolling period. There is no special visa for you to stay longer unfortunately.
