What options are available to individuals who have FLR FP leave to remain (on the basis of being a parent of a british child). In relation to sponsoring a spouse to the UK.

Generally a person must be present and settled in the UK in order to sponsor a spouse to the UK. There seems to be nothing to reflect this for those with FLR FP leave to remain in the immigration rules? Is there any case law which can reflect this?

I have looked everywhere but I cannot find an answer :cry:

My understanding is that you cannot sponsor a spouse until you have obtained ILR.

If your spouse qualifies for a visa in her own right, she could apply for one, i.e. student visa or Tier 2 General work visa.

I have come to a similar conclusion but is it not a right of an individual? I mean they are granted a visa based on their relationship with a British child. The Visa4UK website also suggests there is an option for temporary leave but the immigration rules are silent on this.. There is absolutely nothing. Surely there would be a case similar to this in the UK courts?
