Dear All. I need help, advice from all of yours please. I Have send an application on October 2017 which is FLR FP my children 7 Year’s route. I am not sure the success of this application. However my application is quite strong we never been overstayed in UK. Never break any immigration laws.We have 8 years and 4 years two children both goes to school. I need to know the avarage time from Home office of the result of this application. I will be 10 years on August 2019. Can I reach the 10 Year’s route in between my FLR FP applicaton result including the court time frame.. if any confusion please aske . Thanks to All.

A full immigration history would be helpful if you are to recieve any responses.
Please include when entered the UK and valid and expiry dates of all visas held. Any applications made and the submission dates.
Where your children born in the UK?

I entered in UK on September 2009 as a tier 4 student. Never been overstayed till now. My first baby born on March 2010. I will try to get the expiry date from all of my visas..

Dear All...whoever read my topics please help me with good advice. After one year my flr fp application has been refused. The base of my application was my daughter who born in here and she is will be 9 years old on March 2019. We Parents Both are Bangladeshi passport. We have good immigration history. Another daughter will be 5 years old on January 2019 and born in here. However we have got the appeal right. In between this time my husband needs 10 months to reach his 10 years residency route. My solicitor assured me my husband will be able to reach his 10 years long residency route in between appeal hearing time. So we have two option now either fight against the refusal in court or spent 10 months to reach the 10 years. My question to all my Brothers and sisters is there any possibility to spent another 10 months from November 2018 to till appeal hearing. Or should we prepared for a good fight in court against the refusal. Solicitor is interested to spent the time by avoiding hearing in the court. He also advised me we will fight against the refusal as well. We just send the appeal to the court. Please give us your good advice comments. Thanks in advance.

Hi Nameera,
Your case is just similar to me. If you further elaborate me about the refusal points so it would be a great help.
My story is I submitted my Tier 1 (Ent) extension application on May 2017. In June 2018 I varied my application to FLR(FP) 7 years route on behalf of my daughter who is residing in the UK over 8 + years. All our staying period is lawful.
The basis of the variation of the application to FLR (FP) was my husband health issue. In August 2018 HO asked the medical letter from us. The letter provided to them in September 2018. After one week HO granted us the permission to stay for the next 6 months until March 2019. In the decision letter, HO said we do meet all of the immigration rules under paragraph 276ADE(1) but they are granting leave outside the immigration rules for 6 months. I am allowed to work full time and preparing a new application to file next year March 2019.
In your case, you asked how to kill the 10 months time the best way to lodge the appeal I don't think so your husband can able to file a new application during this time but at the time of hearing, you can submit extra evidence that your husband is completed 10 years lawfully in the UK. Your case will be more strong and the court normally looks at whole family circumstances. In the meantime, I think your section 3C will continue until the outcome of the appeal.

Your solicitor is right. U can easily spend 10 months in appeal process depends on your location. If u live in london than u can easily spend the time in appeal process. Once your husband complete his 10 years, he should withdraw his appeal and apply 10 years Long residence same day. Once he got his ILR. U all will be ok.
