TIER 1 ENT Dependent Qusetions

Hi All,

First of All,not sure if its the right Category to post this, if not then please move my post to correct category.

My Background.

Entered UK : Dec 2008 Student Visa
Then changed the Visa to PSW
Then applied for Entrepreneur and got visa on March 2015
At Present my Tier 1 Extension Application is with HO Since March 2018

My Dependent came to UK in March 2010. since then they are in UK With Valid visa but went to home county for More then 6 Months but their visa was valid.

Now My Question.

If my entrepreneur visa extension gets approved and after that i want to apply for ILR Based on 10 Years Route. Will my Dependent be eligible to apply for ILR Once i got my ILR as they came to UK Before 2012.

or do they need to apply in Different category, As someone told me that if my dependents are with me before March 2012, then they are eligible for Ilr along with Main Applicant, once Main Applicant got ILR.

Or Do they have to be on ilr Dependent visa for another 5 years.

If my dependent is eligible for ILR once i got mine, can someone please share the Guidance link where it says regarding the above rule.

No, 'someone' told you incorrect information. ILR based on long residence does not permit dependents to apply for ILR with you or once you have ILR.

Or Do they have to be on ilr Dependent visa for another 5 years.

Dependent has to switch to FLR(M) which resets the 5 year clock for ILR, 2 x 2.5 year visas.

Not applicable as the rules changed in April 2014 for PBS dependent of ILR Long Residence applicants. See link below.

So for me best option is go for 5 year Based ILR Rather than 10 Years.
