ILR Eligibility Date - calculating continuous period

Post by Arun211 » Tue Oct 16, 2018 12:06 pm

Hi,

I am looking to understand my earliest eligibility date for submitting ILR application. Below is my case:

1) I came in to UK in 21st Nov 2010 in Tier2 ICT
2) Switched in-country to Tier 2 General - Applied by post on 25th Mar 2015
3) Received Visa a month later i.e. Visa issue date is 30th April 2015

1) Considering the above timelines, Will i be able to submit ILR application 28 days before my Tier 2 General date of application i.e. in Feb 2020 ?
2) I am referring to page 9 in the below document under "Calculating the specified continuous period" section
https://assets.publishing.service.gov.u ... .0-EXT.pdf

Please let me know

Cheers

Your 5 years counts from the date your Tier 2 General visa was issued. You can apply no sooner than within 28 days of that.

The paragraph you are referring to does state 'counting backwards from date of ......', ie date of ILR not date of Tier 2 Gen application.

Also, If there is a shortage of 20 days to reach 5 years continuous residence, How do we handle this?

Visa issue date : 30th Apr 2015
Visa Expiry date : 17th Mar 2020

Going by the above dates, I will be able to submit ILR by 2nd April 2020. However the Visa expiry date is before that. Do i need to max out T2 General and extend for another year?

Cheers
