Which form to use for child born in uk with Indian passport?

Which form to use for child born in uk with Indian passport?

Hi guys,


I would appreciate advice on which Form to choose to make an application for my child born in U.K. holding Indian passport. Is it set F?

My visa status - ILR
Previous immigration history - Tier 1 settlement set o application in 'may 2016 with minor below £500 tax liability during 2013. Application held for 18 months. Switched to Set LR in oct 2017 before decision. Refusal in mar 2018 on set LR but FTT appeal allowed. First DL granted in Sep 2018 and then ILR granted this month.

Child born in June 2016, Indian passport applied and obtained in April 2018 as thought might go to India, but eventually ilr granted so now need to apply ilr for child now.

Amy advice on which form to use is highly appreciated? Also out of job since refusal in march 2018. Would that affect the child's application? My spouse recently joined her job a month ago after DL was granted. Spouse is on DL 30 months and we don't plan to change her visa to ilr for at least a year. Would this affect child's application?

If you have ILR, you can register your UK born child as British on form MN1 and skip ILR.

Apologies if I am being repetitive. I wonder whether I am allowed to skip ilr and directly go to MN1 form, as child is already Indian citizen as registered at Indian consulate in uk, but never been out of uk yet, holding Indian passport. Would/wouldn't that be detrimental?

Only reason I am asking is I was unable to find any guidance notes on that. If you'd be kind enough to guide me to it that'll be awesome. Also is there any link in regards to the timeline of the application process?

No effect. Not sure why you think this will be 'detrimental'. Child will lose Indian citizenship though. A UK born child DOES NOT require ILR as I have already said and as has been posted many times on the forum, they have an entitlement to register as British under Section 1(3) of the nationality act.

Thank you much for the links CR001. By guidance notes I meant, if there were any for MN1 soecifically that states similar circumstances, but I Read the links provided and understood better. It seems that it takes about 3 - 6 months for the process. If child needs to travel in between this time frame would the child be able to re-enter? I presume not as child needs an ILR? Is it so?

What happens when we apply for MN1 and in the meantime if due to emergency (hope not) the child as she is just 2 years old needs to travel with parents? Is there any arrangements for such an situation. I looked up the timeline link. I would appreciate your advice on the quickest way to apply and get at least a travel document so child could travel.

Without a visa or a British passport, child won't be able to re-enter the UK or even get on a plane.

Approvals sometimes take a couple of months and you can apply for citizenship (online form) and passport (paper form) at the same time using NDRS at the council (for now, it will likely be changing next month or so).

:oops: :D true. Stupid question. Of course one needs a visa/passport to enter. I was just wondering if any other visa options available, but understand none other than mn1 or ilr.

Thanks for the advice. I will apply on MN1 form. Do I need to have a solicitor or legal representative or is it straight forward enough for a layperson to do it?

On the Form MN1 Application form (version 07/2018) I couldn't find any address to post. Does it mean that it needs to be filled just online?

Also in this scenario would I be using the form MN4 for registering the child for citizenship?
